PARTICIPATION IN THE AFFILIATE PROGRAM​

By participating in the Affiliate Program, you hereby agree to be bound by the following Terms and Conditions.

All decisions made by Smart Marketing Solutions ( S.M.S ) are final and binding.

In order to enroll in the Affiliate Program, you need to submit your application through the affiliate signup form on the Smart Marketing Solutions website (the Website). All affiliate signups are reviewed by us before deciding if an application is accepted. 

Smart Marketing Solutions may terminate the Program and Application at any time with or without notice or reason.​

As a Smart Marketing Solutions Affiliate, you agree that:

    It is your full responsibility to provide us with accurate account information and it is your responsibility to keep that information up to date. Such information includes, but is not limited to: contact details, payment details, tax information, all website URL(s) where S.M.S. is promoted, traffic sources, promotional means and practices, and any other details we may request. 

•  You agree that you are NOT allowed to do the following things if approved for the affiliate program. By doing any of the following, you will be terminated from the program and agree that any commissions will be forfeited without recourse:

• Affiliate Program can not be combined with other referral programs. 

*You are NOT permitted to conduct e-mail promotions in a 3rd party system - all e-mail contacts MUST be your OWN opt in e-mail list. *You cannot buy solo ads, use safe lists, use spam or anything similar.

*You must NOT run "negative" PPC or i-frame domain campaigns such as "Product name / author name scam" or any other method to attract controversial click thru rates that an ordinary person would deem to portray a negative view of the product. This creates a very bad image for our company and the individuals featured in the products and you will be terminated from the program instantly.

*You should not use any marketing practices that may attract clients that are not in good standing.
*You should not act in your own will as per modifying, copying or altering any banners, icons, graphics or any other content that is contained in S.M.S’s Links including but not limited to altering and modifying any copyright or trademark notices, without prior written approval from Smart Marketing Solutions.

*You shall not use self-referral methods, you can’t click on your affiliate links and/or banners and make orders via your unique affiliate link.

*You should not make any recommendations or take any actions that would result in a potential revenue loss for Smart Marketing Solutions.

Social Media Automation Tool

•  The Social Media Automation Tool is provided by Manychat, Inc.

•  Manychat offers a social media automation platform that is accessible to members of the Smart Marketing Solutions affiliate program.

•  Affiliates may use the Manychat platform to create and utilize automation tools, particularly for Instagram, to support and optimize their social media marketing efforts.

•  As a Manychat partner, Smart Marketing Solutions provides a setup service for new affiliate program partners. This service may include creating, configuring, and customizing social media automation using Manychat platform. Smart Marketing Solutions may charge a nominal fee for this service, offering a special discounted price (exclusively for affiliate program members).

•  Please note that Smart Marketing Solutions is not responsible or liable for the results, performance, availability, or use of the Manychat platform by affiliates. Affiliates are responsible for their own use of the Manychat platform and for complying with Manychat's applicable terms, policies, and requirements.
     

Ready-Made Social Media Content

•  Smart Marketing Solutions provides ready-made social media content free of charge to help new partners increase their reach, attract an audience, and effectively promote their affiliate links across social media platforms.

• The ready-made content provided to Smart Marketing Solutions program members may include social media posts, videos, images, carousels, and other promotional materials.

• All content created by Smart Marketing Solutions is provided solely for the purpose of promoting Smart Marketing Solutions campaigns and may be used only for this purpose.

• Any unauthorized use, reproduction, modification, distribution, or other use of content created by Smart Marketing Solutions for purposes other than promoting its marketing campaigns constitutes a violation of the creator's rights and a breach of these Terms and Conditions. Such unauthorized use may also result in legal liability.

AFFILIATE COMMISSIONS

• The Smart Marketing Solutions affiliate program offers affiliates the opportunity to earn a $3 commission for each successful referral. By using social media automation tools and ready-made content to distribute a high-demand digital product free of charge, affiliates can earn a $3 affiliate commission for every successful download generated through their personal affiliate link.

• A successful referral is defined as a new user who downloads the step-by-step guide on how to build a successful online business through an affiliate's personal affiliate link.

• Payout requests for commissions earned during the previous payable period must be submitted to the designated email address by the end of the current month. 

• The minimum payout threshold is $50. Affiliates must accumulate a minimum commission balance of $50 to be eligible to request a payout. 

• Smart Marketing Solutions reserves the right to change the commission structure and/or the method used to calculate commissions at any time. Any such changes may apply to future referrals and commissions.

RELATIONSHIP OF THE PARTIES

Both the Affiliate and Smart Marketing Solutions agree that they are entering into this Affiliate Agreement as independent contractors and this agreement creates no partnership, agency franchise, joint venture, sales representative or employment relationship between them. You have no authority to accept or make any representations or offers on the behalf of Smart Marketing Solutions. You cannot make any statements on your website or otherwise that would contradict anything in this section.

CHANGES TO THE AFFILIATE PROGRAM TERMS

We remain the right to change any policies or terms of this Affiliate Agreement at any time. The amendments and/or supplements of the Agreement are effective immediately upon being posted to the Smart Marketing Solutions website. The current Terms and Conditions of the Affiliate Agreement are always available publicly on Smart Marketing Solutions website. If by any means you do not agree with the amendments and/or supplements of the Affiliate Agreement, you can cancel your account within 10 business days, counting from the date of the amendments and/or supplements.

GOVERNING LAW

Any controversy, claim or dispute arising under this Affiliate Agreement will be resolved according to the jurisdiction and legislation where the Smart Marketing Solutions entity servicing your Affiliate account is located.

ACCOUNT TERMINATION

At any time you can cancel and terminate your affiliate account by contacting us through the Email. Smart Marketing Solutions will send you a confirmation that your account has been terminated, as requested.

Smart Marketing Solutions can terminate an affiliate account:

With a seven-day prior notice without providing any explanation.

Immediately without any prior notice, if your affiliate account or you violate the Affiliate Program Terms and Conditions.

After an affiliate account is terminated, the sales associated with the affiliate will no longer be tracked by us and you will no longer qualify for any future Commissions.
